Terms and Conditions of Service

1. Definitions

- "We", "Us", "Our": Refers to Truly Yours Agency / I’m Your P.A. Limited.
- "Client", "You", "Your": Refers to the person or business receiving our services.
- "GHL": Refers to Go High Level, the CRM and automation platform used to deliver services.

2. Scope of Services

We provide marketing automation, CRM configuration, email marketing, AI-powered content tools, and campaign support using the Go High Level platform. Funnel building, AI automation, email campaign creation, and CRM setup are available on a quoted basis. All additional technical work is billed hourly.

3. Packages and Pricing

3.1 £125/month plan includes:
- Up to 2 users
- Up to 1,500 contacts
- Email monitoring
- Emails and texts included under the Fair Usage Policy

3.2 £150/month plan includes:
- Unlimited users and contacts
- Email monitoring
- Emails, texts, WhatsApp, and other messaging services charged separately

3.3 All additional work outside of the above packages is quoted and billed at:
- £60/hour for basic work
- £75/hour for template setup and intermediate tasks
- £90/hour for complex automations, troubleshooting, and rebuilds

3.4 Support via WhatsApp is included for all clients. Platform access is provided but not white-labelled.

4. Fair Usage Policy (FUP)

Our £125/month plan includes balanced usage of core platform features:

Monthly Allocations:
- Emails: Up to 5,000 email sends per month
- SMS: Up to 500 domestic SMS messages per month (MMS = 3 SMS credits)
- AI tools: Up to 5,000 AI-generated words per month

Guidelines:
- Unused allocations do not roll over
- Exceeding limits may result in usage restrictions
- Consistent overuse may prompt a usage review or require plan upgrade
- Additional usage is available at competitive rates

We monitor account usage to ensure fairness and service quality.

5. Client Responsibilities

5.1 Clients must provide accurate, legal, and permission-based data.

5.2 Clients agree not to make unauthorised changes to their automations or CRM settings.

5.3 Any client-side issues that result in platform errors or malfunctions are chargeable to resolve, typically at £90/hour.

5.4 We are not liable for disruptions caused by client modifications.

6. Platform Repairs and Rebuilds

6.1 If a client alters their setup and causes system damage, we will charge for time spent investigating and repairing issues.

6.2 Rebuilds, reconfigurations, or re-training are also chargeable, typically at £90/hour. Quotes may be provided for larger jobs.

7. Intellectual Property

7.1 We retain ownership of all templates, systems, and content developed until full payment is received.

7.2 Upon full payment, clients receive a non-exclusive licence to use custom-built materials within their own business.

8. Termination

8.1 Services are provided on a rolling monthly basis.

8.2 One full calendar month’s notice is required to cancel.

8.3 No refunds will be issued for partially used months.

8.4 We reserve the right to terminate services immediately for non-payment, abusive conduct, or breach of terms.

9. Support

9.1 Basic support is provided via WhatsApp across all packages.

9.2 Additional training or troubleshooting may be billed separately depending on the complexity of the request.

10. Limitation of Liability

10.1 We are not liable for loss of data, income, or reputation due to third-party issues or user error.

10.2 Our total liability is limited to the value of one month’s service fee.

11. Governing Law

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the English courts.
